Chair Sheffield called the meeting to order at 6:00p.m. with a quorum and then led in the Pledge of Allegiance to the U.S. Flag.

 

2.       Introduction of Members/Roll  Call

3.      Approval of Minutes – May 10, 2012   Rowan/Bright 9-0

5.      Special Area Plan Workshop – Lake Talquin/Wetumpka and Midway/Highway 90  

Mr. Matheny gave overview of Workshop and the time line of the Special Area Plans and EAR –Based Amendments.

 

Mr. Jon Sewell said on US 90 it is pretty much final.  He said everything they have discussed previously is included in the package handout.

Proposed Amendments

·        Policy 1.1.5 (A) (1) (c) – Commissioner Ganus recommendation –Addition of text from the previously stricken Policy 1.15.4 stating that the county shall not approve large scale amendments from the Ag land use category to a denser land

·        Policy 1.7.3 – Revision of text to replace reference to 208 Water Quality Requirements with references to state and Regional Water Quality Management Plans and surface water quality standards identified in the Florida Administrative Code.

Consensus to add Ochlocknee River.

Final Comments

Commissioner Ganus – Include the following policy language in the Infrastructure Element and the Capital Improvements Element.

 

Ganus – It was in Old Comprehensive Plan -2001, Capital Improvement and Infrastructure. (Consensus to add)

Policy 5.2.22 – basic language should be added back. In the Conservation Element, include the following policy as 5.2.22 and renumber subsequent policies.

·        Policy 5.2.22: Illegally operating non-conforming land uses affecting environment sensitive lands, as defined in Policy 5.31.1, shall be addressed in accordance with provisions and requirements for non-conforming uses in the Gadsden County Land Development Code.

 

Sewell – We can develop clearer language which develops both. He said they would get back to them in email.

 

Matheny – reminded everyone not to discuss among each other, get comments back to him.

·        Revise the WLTO Vision to state:

·        Per feedback from Lake Talquin Area residents, amend the overlay area to extend westward to County Road 65.

 

Ganus – How can we determine what the boundary line, if the study won’t be complete until next year.

 

Sewell – He said there was a line drawn 1 mile west of State Rd 267. It was drawn through public involvement.

Allen – Maps were not provided. He said now they are getting looked at.

Ganus – reword the study to

Matheny - say initially do the overlay in a mile, going to 65 is second option. When the study is complete in 2013, these boundaries may change.

Sewell – In place temporary until study is done, expanding 3 to 4 miles out to Hwy 65.

Simmons – Not in favor of prohibiting growth.

Matheny – It’s making it harder; searching for temporary line until study is complete.

Simmons – In favor of keeping at a mile. I have reservations. (Opposed)

Allen – If you go to 65 it covers majority.

Davis – the April 12 meeting, where are those people.

Sheffield - 5-4 to move to Highway 65 (opposed - Rowan, Simmons, Butler, Davis)

Sewell – Final Changes(review and let us the questions are comments.)

 

Ganus – Policy 4.7.9 (Infrastructure Element) – The County will obtain periodic monitoring reports to determine if there are any threats or potential negative impacts from water transfers.

Sewell – Doesn’t effect the City of Gretna, with Bottling Plant.

 

We will more forwarded to the Public Hearing. (Black & White, Color One – Electronic.

Matheny – thanked Council for hardwork.

6.      EAR Based Amendments Workshop

7.      Public Comment – Next meeting Aug. 16, 2012

Ken Stratfit representing C.W. Roberts – we objective to any line be drawn out 5 miles further. (against) Notify all people in the 5 mile radius. Once boundary is adopted it’s permanent until it’s changed. He said this is backward and no basis.  Study needs to be done first. We have requested land use change 64 mining/79 conservation.

 

Robinson – Agreed with comments, tabling until study is done.

Allen – referenced comment.

Darrin Taylor, Carlton Fields-BASF & Anderson & Columbia – I have concerns with the product that are there. I provided concerns and some were addressed and some weren’t. Language in here,that will cause problems. Some language is in question. Recommendation – will update with formal comments, some major issues need to worked through.

 

Ganus – How will get your comments.

Taylor – I provided comments to consultants on June 11.

Sewell – Some we disagreed with. We will be happy to provide comments.

Matheny – we will email to Council and you can get feedback.

Simmons – process needs to adjusted. We should have all information; it needs to come before the Council.

Ganus – what’s the volume of comments, could be emailed.

Davis – What is legal standpoint is from the County Attorney.

Weiss – I am certainly happy to look into information, not authorized to look at all documents and attend all meetings.

Matheny – limited budget, for these type of meetings. Legal expenses have to be keep at a minimum.

Simmons – bring information to Council.

Ganus – Please send info to Council.

Sheffield – Do we want to change.

Davis – Need legal standpoint.

Weiss – I think ideally we should have study before we draw the line.  He said what are the issues.

Sheffield – Primary thing is protecting water quality.

Sewell – by placing a date, they would have pressure to do study.

Davis – Can language be challenged, by property owners by setting the boundaries before the study.

Weiss – Any boundary you set can be challenged.

Matheny – other option – delay plan to you do study. Any boundary you set is open to a legal challenge.

Consensus – go with the Highway 65.

Matheny – We are emailing comments from Mr.Taylor, Mr.Straffit. I will look at again with all players. Would you like to delay meeting to have time to review comments.

Consensus – to move meeting to August 30, 2012.

Weiss – reminded Commission not to talk among each other.
